29 CFR 1910.1001(j)(2)(i): The building owner, facility owner or employer did not determine the presence, location, and quantity of ACM or PACM at the worksite and did not exercise due diligence in complying with these requirements to inform employers and employees about the presence and location of asbestos-containing material (ACM) and presumed asbestos-containing material (PACM):    a) Boiler Room, Palisades Nursing Center, 6819 Boulevard East, Guttenberg, NJ 07093.    The employer did not perform a survey or inform the employees of the presence and location of ACM and/or PACM.   The maintenance and custodial employees are required in their duties to enter this area which contains damaged thermal systems insulation with 5% to 25% chrysotile asbestos.       Condition observed on or about 12/16/2013.

29 CFR 1910.1001(j)(4)(i): Warning labels were not affixed to all raw materials, mixtures, scrap, waste, debris, and other products containing asbestos fibers, or to their containers:    a) Boiler Room, Palisades Nursing Center, 6819 Boulevard East, Guttenberg, NJ 07093.    The employer did not affix asbestos warning labels where ACM was present to including thermal systems insulation on piping.  The two bulk samples taken on the thermal systems insulation were found to contain 5% and 25% chrysotile asbestos, respectively.      Condition observed on or about 12/16/2013.

29 CFR 1910.1001(j)(7)(iv): The employer did not provide, at no cost to employees who perform housekeeping operations in an area which contains presumed asbestos-containing material (PACM) and/or other asbestos-containing material (ACM), an asbestos awareness training course:      a) Boiler Room, Palisades Nursing Center, 6819 Boulevard East, Guttenberg, NJ 07093.    Employees who performed maintenance and housekeeping activities in the boiler room area where asbestos containing thermal insulation was located were not provided asbestos hazard awareness training.  Two bulk samples of the damaged thermal systems insulation were found to have 5% and 25% chrysotile asbestos respectively.       Condition observed on or about 12/16/2013.
