29 CFR 1910.22(b)(1): Where mechanical handling equipment is used, sufficient safe clearances shall be allowed for aisles, at loading docks, through doorways and wherever turns or passage must be made. Aisles and passageways shall be kept clear and in good repairs, with no obstruction across or in aisles that could create a hazard. a) On or about September 17, 2013, and at times prior to, employees operated a forklifts and walk in warehouses A/B with holes 2.25-5.0 inches deep on the floors, exposing employees to struck-by, crush-by, tip-over, trip and fall hazards. ABATEMENT CERTIFICATION IS REQUIRED.

29 CFR 1910.23(e)(7)(iii): The construction of floor opening covers may be of any material that meets the strength requirements. Covers projecting not more than 1 inch above the floor level may be used providing all edges are chamfered to an angle with the horizontal of not over 30 degrees. All hinges, handles, bolts, or other parts shall set flush with the floor or cover surface. a) On or about September 17, 2013, and at times prior to, employees operated a forklifts and walk in warehouses A/B with some metal plates edges projecting more than 3.5 to 4 inches above the floor, exposing employees to struck-by, crush-by, tip-over, trip and fall hazards. ABATEMENT CERTIFICATION IS REQUIRED.

29 CFR 1910.178(p)(1): If at any time a powered industrial truck is found to be in need of repair, defective, or in any way unsafe, the truck shall be taken out of service until it has been restored to safe operating condition. a) On or about September 17, 2013, and at times prior to, employees operated a forklift that did not have functioning brakes for six months. Employees used the forklift to move containers and heavy equipments, exposing employees to struck-by and crush hazards.
