OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards: a. On or about September 17, 2013, at Building 8 near the steps, the employee cleaning gutters was using a 24-foot extension ladder to access and exit from the roof. The ladder was not extended 3 feet past the landing. Abatement Certification and Documentation are not required

29 CFR 1910.132(a): Protective equipment was not used when necessary whenever hazards capable of causing injury and impairment were encountered: a. On or about September 17, 2013, Building 8 roof, the employer did not provide fall protection for the employee cleaning gutters. The employee cleaned the gutters by sitting on the roof then leaning over to scoop out the debris, exposing himself to a 17.5 feet fall hazard. Abatement Certification and Documentation are not required
