29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets: (a) On or about September 10, 2013, at a job site located at or near Valley Road and W 6rd Street in Kansas City, MO, an employee, who was not wearing a hard hat, was observed to be working in a trench while a backhoe was continuing to excavate in proximity to the employee.
