29 CFR 1926.20(b)(2):  The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person (i.e., a person who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has the authority to take prompt corrective measures to eliminate them):     (a)    New Town Builders at 2845-2839 W. 52nd Ave., Denver, CO 80221:  On and before July 10, 2013, the controlling employer did not ensure a safety program was implemented for the work environment to include regular inspections of the job-site, materials, and equipment; conducted by a competent person.  Three subcontractor employees were working next to the edge of the garage roof and on a pump jack scaffold at a multi-family residential home without the use of a fall protection system.  The subcontractor employees were siding the exterior wall of the 2nd level of the home.  These conditions exposed employees to fall hazards of approximately 11.2 and 16.9 feet to the ground below.

29 CFR 1926.451(g)(1):  Each employee on a scaffold 10 feet above a lower level was not protected from falling to the lower level:    (a)   New Town Builders at 2845-2839 W. 52nd Ave., Denver, CO 80221:  On and before July 10, 2013, the controlling employer did not ensure that employees were protected from a fall from elevation in that guardrails or other suitable fall protection were not properly installed on the working platform of the pump jack scaffold.  The scaffold lacked mid rails, top rails, and end rails.  This condition exposed the employees to a fall of approximately 16.9 feet.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net system, or personal fall arrest system, nor was an alternative fall protection measure provided:  (a)    New Town Builders at 2845-2839 W. 52nd Ave., Denver, CO 80221:  On and before July 10, 2013, the controlling employer did not ensure employees were protected from injury, in that employees engaged in siding activities while standing on the top of a garage roof of a multi-family residential home had exposure to a fall hazard from not utilizing a fall protection system.  This condition exposed the employees to a fall hazard of approximately 11.2 feet.
