29 CFR 1910.1200(e)(1): The employer did not develop, implement, and maintain at each workplace, a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, material safety data sheets, and employee information and training will be met: a). On or about 9/18/13, at the machine shop, for the employees that uses Castrol Clearedge, which is a metal coolant, on a daily basis. Castrol Clearedge contains chemicals such as, but not limited to, ethanol and petroleum. The employer did not implement a written hazard communication program to include labeling requirements.

29 CFR 1910.1200(f)(5)(i): The employer did not ensure that each container of hazardous chemicals in the workplace was labeled, tagged or marked with the identity of the hazardous chemical(s) contained therein: a). On or about 9/18/13, at the machine shop, for the employees that uses Castrol Clearedge, which is a metal coolant, on a daily basis. Castrol Clearedge contains chemicals such as, but not limited to, ethanol and petroleum. The employer did not implement a written hazard communication program to include labeling requirements. b). On or about 9/18/13, at the machine shop, for employees dispensing oil into totes to be recycled out. The totes were not labeled.
