29 CFR 1926.21(b)(6)(i): Employees required to enter into confined or enclosed spaces were not instructed as to the nature of the hazards involved, the necessary precautions to be taken, and in the use of protective and emergency equipment required: a) Employees required to work in confined and enclosed City of Chicago sewer spaces during Cured In Place Pipe (CIPP) construction work were not provided with safety instructions regarding the locations and functions of Intake Restrictor Valves used in connection with the City of Chicago's "Rainblocker" program for flood control measures that can affect the flow of liquids within the sewers. b) Employees required to work in confined and enclosed City of Chicago sewer spaces during CIPP construction work were not provided with safety instructions regarding the locations and functions of Tunnel and Reservoir Plan (TARP) and tide gates that are controlled, interconnected, operated, and monitored by the Metropolitan Water Reclamation District (MWRD) for flood control measures that can affect the flow of liquids within the sewers. c) Employees required to work in confined and enclosed City of Chicago sewer spaces during CIPP construction work were not provided with safety instructions regarding the hazards of being flushed from sewers into the Deep Tunnel where TARP gates are controlled, interconnected, operated, and monitored by the MWRD for flood control measures that can affect the flow of liquids within the sewers. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.
