29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net system, or personal fall arrest system, or other approved alternative fall protection system. (a) Vertex Homes LLC at 2217 Trestle Road, Fort Collins, CO 80525: On and before September 17, 2013, the exposing employer did not ensure that employees were protected from injury, in that employees were exposed to fall hazards in residential activities 6 feet (1.8 m) or more above lower levels. This condition includes but is not limited to: 1) Two employees were engaged in setting trusses from the 2nd story roof of an apartment building with a fall hazard of approximately 8-10 feet without the use of a fall protection system. 2) Three employees utilizing the interior stairway inside the building under construction to gain access to the second level was not equipped with an adequate stair rail system. Employees utilizing the stairs to reach the second level of the home were exposed to fall hazards of approximately 8-10 feet.
