OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that the employee who was standing on the bucket of an excavator was not protected from falling or struck-by hazards: a) Elk Moutain Ski Resort, Union Dale, PA: The employer did not prohibit an employee from riding or standing on the bucket of a Catipillar 311C hydraulic excavator while working over a pond with a water depth of approximately 8 feet, exposing the worker to a fall and struck-by hazard from inadvertant operation and movement, on or about September 24, 2013. ABATEMENT CERTIFICATION REQUIRED
