29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent:        On September 24, 2013, at the shop, the employer did not ensure employees were protected from noise exposure. 29 CFR 1910.151(c): Where employees were exposed to injurious corrosive materials, suitable facilities for quick drenching or flushing of the eyes and body were not provided within the work area for immediate emergency use:      On or about September 24, 2013, at the shop, the employer did not have an eye wash station for quick drenching or flushing of the eyes and body for employees handling corrosive chemicals including but not limited to methanol, dibutyltin dilaurate, silica, amorphous, benzoyl peroxide, 1-methoxy-2-propanol, acetone, 1,2,4-Trimethylbenzene, and styrene, while cutting, sanding, grinding and buffing granite countertops and backsplashes. This condition exposed employees to injurious corrosive materials that would cause loss of vision, skin burns, and rashes constructing countertops and backsplashes.

29 CFR 1910.178(l)(1)(ii): 29 CFR 1910.178(l)(1)(ii):  The employer did not ensure that each operator had successfully completed the training required by paragraph (l), except as permitted by paragraph (l)(5), prior to permitting an employee to operate a power industrial truck:     On or about September 24, 2013, at the shop, the employer did not ensure that each forklift operator received powered industrial truck operator training and evaluation. An employee operating a forklift to transport slabs of granite, granite countertops and backsplashes had not been certified and trained in the safe operations of the vehicle. This exposed employees to struck by hazards.

29 CFR 1910.37(a)(4):   Safeguards designed to protect employees during an emergency (e.g., sprinkler systems, alarm systems, fire doors, exit lighting) must be in proper working order at all times.   On or about September 24, 2013 and at times prior thereto, at the shop, the employer did not ensure that safeguards designed to protect employees during an emergency were in proper working condition at all times. At the east exterior wall, the exit lighting sign was missing from its casing. This condition creates delay in exiting the building in an emergency.

29 CFR 1910.134(c)(2): The employer did not develop and implement a respiratory protection program in accordance with sections i and ii of this paragraph (c)(2) for employees who chose to wear respirators where respirator use was not required:     On or about September 24, 2013, at theshop, the employer did not provide Appendix D information to employees using respirators when not required to under the OSHA standard. Employees performing sanding, cutting, grinding and polishing operations on granite slabs were voluntarily using respirators e.g. N95 dust masks to protect themselves from airborne dust containing Silica.

A non-metallic, self-closing lid, receptacle cover was missing from the electrical outlet exposing employees to electrical shock and / or electrocution hazards.
