The employees were exposed to fall and struck-by hazards.

29 CFR 1926.454(a): The employer did not have each employee who performed work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards:   (a) Employees installing a brick veneer on a 2-story single family residence were not instructed in the recognition and avoidance of unsafe conditions when using tubular welded frame scaffold systems, exposing the employees to a fall hazard of approximately 14-feet to the next lower level.

29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:  (a) Protective helmets were not provided to employees exposed to overhead hazards from material and equipment being used on a tubular welded frame scaffold to install a brick veneer on a 2-story single family residence. Employees were exposed to a struck-by hazard from bricks being tossed and placed on the uppermost work platform of the scaffold system, approximately 14-feet above ground level.

The employees were exposed to a fall of approximately 14-feet to the next lower level.

29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used:   (a) On the northeast side of the 2-story single family residence, employees were climbing the prefabricated end frame of a tubular welded frame scaffold as if the frame had been designed for use as ladder rungs. The employer did not provide an access ladder, exposing the employees to a fall hazard of approximately 14-feet.

The employer did not ensure that employees working at lower levels were protected by installing toeboards or barricading the area below the scaffold platform.

Cross braces had only been installed on certain portions of the scaffold system, exposing the employees to a fall hazard of approximately 14-feet to the next lower level.
