29 CFR 1910.178(i)(1): Concentration levels of carbon monoxide gas created by powered industrial truck operations exceeded the levels specified in 1910.1000:     a)      NACA Logistics USA, Inc. dba Vanguard Logistics, 300 Middlesex Avenue, Carteret, NJ site  Facility: The concentration levels of carbon monoxide (CO) gas created by the powered industrial trucks exceeded the OSHA Permissible Exposure Limit (PEL) of 50 parts per million (ppm).  Approximately 10 to 12 powered industrial trucks were operating on the main floor of the warehouse that contributed to the CO level of 94.6 ppm (8-hour Time Weighted Average) which an employee was exposed to.       Violation occurred on September 25, 2013.

29 CFR 1910.1000(a)(2): Employee(s) were exposed to an airborne concentration of carbon monoxide listed in Table Z-1-A (Transitional Limits Column) in excess of 50 parts per million (ppm) as an 8-hour Time Weighted Average (TWA) concentration:   a)      NACA Logistics USA, Inc. dba Vanguard Logistics, 300 Middlesex Avenue, Carteret, NJ site  2nd Floor Office Space: While approximately 10 to 12 powered industrial trucks were operating on the main floor of the warehouse, an Employee conducting desk duties in the Export/Customer Service Department was exposed to carbon monoxide (CO) during a 90 minute occupational exposure at a mean calculated 504.8 ppm CO level.  The percentage carboxyhemoglobin (%COHb) in the employees blood reached a calculated peak level of 13.9%.  Atmospheric pressure, height, weight, activity levels, tobacco smoking behavior, and other factors were taken into account.  The 8-hour TWA exposure was 94.6 ppm CO, which was 1.89 times the OSHA PEL of 50 ppm.      Violation occurred on September 25, 2013.

29 CFR 1910.178(l)(1)(ii): Prior to permitting an employee to operate a powered industrial truck (except for training purposes), the employer shall ensure that each operator has successfully completed the training required by this paragraph (l), except as permitted by paragraph (l)(5).     a)      NACA Logistics USA, Inc. dba Vanguard Logistics, 300 Middlesex Avenue, Carteret, NJ site  Warehouse: Operators were not trained in the safe operation of powered industrial trucks such as, but not limited to Toyota 7FGCU25, etc. exposing them to a crushing hazard in the event of a rollover/tipover.       Condition noted on/or about September 25, 2013.          Training shall consist of a combination of formal instruction, practical training, and evaluation of the operators performance in the workplace.

29 CFR 1910.1000(e): Feasible administrative or engineering controls were not determined and implemented to achieve compliance with the limits prescribed in 29 CFR 1910.1000(a) through (d):     a)      NACA Logistics USA, Inc. dba Vanguard Logistics, 300 Middlesex Avenue, Carteret, NJ site  Facility: Engineering control was not implemented to achieve compliance when an employee is overexposed to carbon monoxide (CO).  While approximately 10 to 12 forklift trucks were operating on the main floor of the warehouse, an Employee conducting desk duties in the Export/Customer Service Department of the 2nd floor was exposed to CO during a 90 minute occupational exposure at a mean calculated 504.8 ppm CO level.  The percentage carboxyhemoglobin (%COHb) in the employees blood reached a calculated peak level of 13.9%.  Atmospheric pressure, height, weight, activity levels, tobacco smoking behavior, and other factors were taken into account. Abatement Note:  General methods of control applicable for the circumstances include, but not limited to the following:       1)      Design and implement effective exhaust ventilation systems for areas where carbon monoxide gas accumulate such as, but not limited to areas and adjacent spaces of high volume forklift truck traffic, etc. (i.e., loading dock and the 2nd floor offices above the loading dock).   2)      Develop and implement a maintenance program for all exhaust systems to assure adequate functionality.   3)      Develop and implement a maintenance program for forklift trucks to reduce the levels of CO produced.    4)      Perform air monitoring/sampling to assure the adequate protection and controls.   5)      Provide employees training on the hazards and health symptoms associated with exposures to carbon monoxide gas.
