29 CFR 1926.451(a)(6): Scaffolds were not constructed in accordance with the design by a qualified person: Employees using a pallet as a scaffold platform that was lifted with the forks of JLG 6042 telescoping boom forklift were exposed to fall hazards in that the platform was not constructed in accordance with the design of a qualified person. The platform was being used to elevate an employee between 18' - 20' at the jobsite located at 426 S. Andover Road, Andover, Kansas.

29 CFR 1926.501(b)(10): Each employee engaged in roofing activities on low-slope roofs with unprotected sides and edges 6 feet or more above lower levels, was not protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system. Or, on roofs 50-feet (15.25 m) or less in width, each employee was not protected by use of a monitoring system: Employees replacing the roof on a commercial building with a low slope roof located at 426 S. Andover Road, Andover, Kansas were exposed to fall hazards of 18' - 20' from the roof to the ground below in that fall protection was not used. Mid-western Commercial Roofers, Inc was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(10), which was contained in OSHA inspection number 314655606, citation number 1, item number 1a and was affirmed as a final order on 11/29/2010, with respect to a workplace located at 344 South 1st Street, Gadsden, AL 35901.
