29 CFR 1910.132(d)(1)(i): The employer did not select and have each affected employee use, the types of personal protective equipment that would protect the affected employee(s) from the hazards identified in the hazard assessment: (a) ColCal Colorado, Inc. DBA Taco Bell, 599 Kokopelli Blvd., Fruita, CO 81521: On and before 9/9/13, the employer allowed employees to use the 190 degree Fahrenheit water from the Bunn machine to clean floor drains. The employer did not select and have each affected employee use, the types of personal protective equipment that would protect the affected employee(s) from a burn hazard. One employee suffered second degree burns to his leg and foot when he was exposed to the hot water being poured down a floor drain.

29 CFR 1910.132(d)(2): The employer did not verify that the required workplace hazard assessment has been performed through a written certification which included the requirements as outlined in 29 CFR 1910.132(d)(2): (a) ColCal Colorado, Inc. DBA Taco Bell, 599 Kokopelli Blvd., Fruita, CO 81521: On and before 9/9/13, the employer did not ensure through written verification that a workplace personal protective equipment (PPE) hazard assessment had been performed. The employer allowed employees to use the 190 degree Fahrenheit water from the Bunn machine to clean floor drains. One employee suffered second degree burns to his leg and foot when he was exposed to the hot water being poured down a floor drain. Abatement note: The employer shall verify that the required workplace hazard assessment has been performed through a written certification that shall include the following: (1) Identifies the workplace evaluated; (2) The person certifying that the evaluation has been performed; (3) The date(s) that the hazard assessment was performed; and (4) Which identifies the document as a certification of hazard assessment.
