29 CFR 1903.19(c)(1): Within 10 calendar days after the abatement date, the employer did not certify to OSHA (the Agency) that each cited violation has been abated, except as provided in paragraph (c)(2) of this section.  a)  901 E. Newport Pike, (Foley Hall) Wilmington, DE - The employer did not provide abatement certification for Citation 1, Items 1 and 2(b), which became final orders on January 14, 2014.  The violation occurred on or about January 14, 2014.  Pursuant to 29 CFR 1903.A9, the employer must submit abatement certification within 10 days after the abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and must state that employees and their representatives were informed of this abatement.

29 CFR 1926.501(b)(10): Each employee engaged in roofing activities on low-slope roofs, with unprotected sides and edges 6 feet or more above lower levels was not protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line systems:  a) 901 E. Newport Pike, (Foley Hall) Wilmington, DE - Employees were observed working on the edge of a flat roof, approximately 30 feet above the ground, without fall protection.  The employees were installing new insulation and EPDM rubber covering for a replacement roof.  This exposed the employees to fall hazards.  The violation was observed on or about October 3, 2013.

The program did not enable each employee to recognize the hazards of falling and did not train each employee in the procedures to be followed in order to minimize these hazards.   a) 901 E. Newport Pike, (Foley Hall) Wilmington, DE - The employees were not provided with training to recognize the hazards associated with roofing work.  They employees were observed working on the edge of a roof, approximately 30 feet above the ground, without fall protection. Newport Pike, (Foley Hall) Wilmington, DE - Employees observed using a Werner 32 foot aluminum extension ladder that did not extend at least 3 feet to access the roof, approximately 30 feet above the ground.  The employees used the ladder to access the roof to installing new insulation and EPDM rubber covering for a replacement roof.  This exposed the employees to fall hazards.
