29 CFR 1926.501(b)(1): Each employee on a walking/working surface (horizontal and vertical surface) with an unprotected side or edge which is 6 feet (1.8 m) or more above a lower level shall be protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. a) North side of jobsite, on top of foundation wall: Two employees were doing maintenance work on a concrete side loader at the edge of the foundation wall. The employees did not have fall protection and were exposed to falling 22 feet to the bottom of the building foundation. On or about 10/02/13. Note: Because abatement of this violation is already documented in the inspection case file, the employer need not submit certification of abatement for this violation as normally required by 29 CFR 1903.19.

29 CFR 1926.602(a)(3)(i): The employer moved or caused to be moved construction equipment or vehicles upon an access roadway or grade without ensuring the access roadway or grade was constructed and maintained to accommodate safely the movement of the equipment and vehicles involved. a) North side of jobsite, access grade from Water Street entrance: A delivery truckused the site ramp and the truck slide down and turned over in an accident when it moved over the wet mud. The employer did not maintain the access grade to accommodate safely the movement of the delivery truck. On or about 10/02/13. NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT CERTIFICATION OF ABATEMENT FOR THIS ITEM. FAILURE TO COMPLY MAY RESULT IN AN ADDITIONAL PENALTY OF $1,000 AS PER 29 CFR 1903.19.
