29 CFR 1926.1101(f)(1)(i): Where exposure monitoring was required under 29 CFR 1926.1101, the employer did not perform monitoring to determine accurately the airborne concentrations of asbestos to which employees were or potentially were exposed: a) On October 7, 2013, employer did not perform the initial monitoring for the work operation. Employees were working in a construction area where the removal of asbestos occurs. Specifically the boiler room operations were not sampled. NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.1101(n)(7)(i): The employer, did not upon written request, make all records required to be maintained by 29 CFR 1926.1101(n) available to the Assistant Secretary and the Director for examination and copying: a) On October 7, 2013, employer did not provide or make the records associated with respiratory protection available to the compliance officer; including written respirator program, fit tests, and medical assessments. Two employees were onsite and both employees were wearing half-mask respiratory protection to remove asbestos contaminated material. NO ABATEMENT CERTIFICATION REQUIRED
