On the site where the owner used a JLG Tough Terrain Forklift to lift employees to the fascia board, the owner did not obtain written permission to attach the platform on the front of ther forklift thereby exposing employees to a fall hazard.

29 CFR 1910.178(l)(1)(ii): Prior to permitting an employee to operate a powered industrial truck (except for training purposes), the employer shall ensure that each operator has successfully completed the training required by this paragraph (l), except as permitted by paragraph (l)(5).    29 CFR 1910.178(l)(2)(ii): Training shall consist of a combination of formal instruction (e.g., lecture, discussion, interactive computer learning, video tape, written material), practical training (demonstrations performed by the trainer and practical exercises performed by the trainee), and evaluation of the operator's performance in the workplace.    a.     On the site where an employee was operating a JLG rough terrain forklift, the employer did not provide a forklift training progrm to teach the safe operation of the rough terrain forklift thereby exposing employees to a struck-by hazard.

Except as otherwise provided in paragraph (b) of this section, each employee engaged in roofing activities on low-slope roofs, with unprotected sides and edges 6 feet (1.8 m) or more above lower levels shall be protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system. Or, on roofs 50-feet (15.25 m) or less in width (see Appendix A to subpart M of this part), the use of a safety monitoring system alone [i.e. without the warning line system] is permitted.    a.     On the roof of the hotel where shingles were applied, the employer did not wear fall protection thereby exposing employees to a fall hazard.
