29 CFR 1926.28(a): The employer is responsible for requiring the wearing of appropriate personal protective equipment in all operations where there is an exposure to hazardous conditions or where this part indicates the need for using such equipment to reduce the hazards to the employees: At the location of 112 Hwy 61, Pratt KS, an employee engaged in moving gypsum board with the use of a forklift was exposed to struck by hazards. The employee was exposed in that the seatbelt, safety equipment on the forklift, was not in use.

29 CFR 1926.501(b)(14): Each employee working on, at, above, or near wall openings where the outside bottom edge of the wall opening is 6 feet (1.8 m) or more above lower levels, shall be protected from falling by the use of a guardrail system, a safety net system, or a personal fall arrest system: At the location of 112 Hwy 61, Pratt KS, two employees engaged in off-loading gypsum boards from the forks of a forklift through a wall opening were exposed to fall hazards of approximately 15 feet from the wall opening edge to the concrete below. The employees were exposed in that a means of fall protection was not in place to keep them from falling.

29 CFR 1926.503(a)(1): The employer shall provide a training program for each employee who might be exposed to fall hazards. The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards. At the location of 112 Hwy 61, Pratt KS, two employees engaged in off-loading gypsum boards from the forks of a forklift through a wall opening were exposed to fall hazards of approximately 15 feet from the wall opening edge to the concrete below. The employees were not training on the means and methods of fall protection to minimize the hazards associated with falling from heights.
