29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury:    (a) Excavation site:  On or about October 10, 2013, and at times prior, employees were exposed to cave in hazards due to lack of adequate training in the recognition of trenching hazards and the means to control these hazards.

29 CFR 1926.651(k)(2): Where the competent person found evidence of a situation that could result in possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employee(s) was/were not removed from the hazardous area until the necessary precautions have been taken to ensure their safety:    (a) Excavation site:  On or about October 10, 2013, and at times prior, employees were exposed to cave in hazards from lack of adequate access and egress from the trench excavation as the extension ladder was located approximately six feet from the outside edge of the trench shield in an excavation that was approximately eight feet deep.
