29 CFR 1926.501(b)(13):   Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by guardrail systems, safety net systems, or personal fall arrest systems, nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502.      a)  Worksite, 102 Michigan St., Long Beach NY - Employees framing a two story residential home were exposed to falling from the second floor approximately 17ft to the ground below.  There were no guardrails or personal fall arrest systems in use; on or about 10/11/13.    Note:  In addition to abatement certification the employer is required to submit abatement documentation for this item in accordance with 29 CFR 1903.19.

29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access:      a)  Worksite, 102 Michigan St., Long Beach NY - Employees were accessing the first floor of a residential home by using an extension ladder that was extended approximately 1 1/2ft above the landing; on or about 10/11/13.      Note:   Because abatement of this violation is already documented in the case file, the employer need not submit certification or documentation of abatement for this violation as normally required by CFR 1903.19.
