The forklift did not have seat belts installed exposing the operator to the hazard of being struck by the overturning forklift.

The facility contained combustible debris, containers, and propane cylinders exposing employees to the hazards of fire.

29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l): Dock and warehouse areas: On or about October 10, 2013, and times prior to, employees unloading package pallets operated a forklift on which they had not received training. This exposed the operator and other employees working in the area to the hazard of being struck by the forklift.
