29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets: A). On or about 10/15/13, at the site of 130-43rd St. South Ozone Park, NY Employees working underneath of scaffolds were in danger of head injury from falling objects such as, but not limited to tools and buckets of stucco from other employees who working on above section of the scaffolds. Protective helmets were not provided. ABATEMENT VERIFICATION IS REQUIRED PURSUANT TO 29 CFR 1903.19

29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used. Crossbraces were used as a means of access: A). On or about 10/15/13, at 130-43rd 115th St. South Ozone Park, NY Employees were ascending/descending scaffolds by climbing the frame and were in danger of falling approximately 18 ft. to the ground. An access ladder or equivalent safe devices were not provided. ABATEMENT VERIFICATION IS REQUIRED PURSUANT TO 29 CFR 1903.19.
