OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees who were exposed to injury from a collapsing temporary stairway system.    WORKSITE: The employer did not ensure through visual observation and specific instructions that the employees, engaged in installing the temporary stairway system (stairs) to be used to carry cast iron tubs up stairs were following the appropriate design and construction specifications and other criteria to ensure that the "stairs" were designed, installed and positively anchored and supported to have the minimum required loading capacity.      On or about October 10, 2013, the "stairs" were displaced and collapsed while employees were performing the above task, causing the employees to fall approximately 19 feet through the first floor opening and to the basement floor. The employees sustained very severe injuries from the incident.

29 CFR 1926.21(b)(2): The employer shall instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury.  WORKSITE: The employer did not provide specific instructions and training in the recognition and avoidance of hazards in workplace conditions which include (but are not limited to) carrying heavy loads on temporary stairs that were not properly installed.
