OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees exposed to falling loads and/or lift parts: (a) Shop Area - An employee used a Rotary lift, model SPOA88, to elevate automobiles. The locking mechanism on the arm was broken thus exposing the employee to injury from being stuck by the falling load and or lift parts. Inspections were not conducted on a regular basis to ensure all components were in safe operating condition, on or about October 18, 2013. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR 1910.22(a)(2): The floor of every workroom was not maintained in a clean and, so far as possible, a dry condition: (a) Shop Area - Rain water leaking into the building and onto the floor created a slip hazard for employees, on or about October 18, 2013. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.
