29 CFR 1926.102(a)(1): Employees were not provided with eye and face protection equipment when using saws and nail guns to cut and install roof sheathing that presented potential eye or face injuries:    a) Lot #136 Hudsons Turn (The Villages of Five Points), Lewes, DE - Employees were observed cutting roof sheathing with Makita saws and nail guns without the use of eye protection.  This exposed the employees to potential eye or face injuries.  The violation was observed on or about October 18, 2013.

29 CFR 1926.451(g)(1)(vii): Each employee on a scaffold, not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, and more than 10 feet above a lower level, was not protected from falls by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section:     a) Lot #136 Hudsons Turn (The Villages of Five Points), Lewes, DE - An employee was observed standing on a platform, approximately 12 feet above the ground, that was lifted by a Gradall all-terrain industrial truck.  The employee was not provided with fall protection as he worked on the lift.  This exposed the employee to a fall hazard.  The violation was observed on or about October 18, 2013.

29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet above the upper landing surface to which the ladder was used to gain access:    a) Lot #136 Hudsons Turn (The Villages of Five Points), Lewes, DE - Employees used a ladder to access the roof that extended 1 rung/foot above the upper landing.  The employees used the ladder to work on the installation of roof sheathing.  This exposed the employees to fall hazards from inadequate access to the roof.  The violation was observed on or about October 18, 2013.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet or more above lower levels  was not protected by guardrail systems, safety net system, or personal fall arrest system:     a) Lot #136 Hudsons Turn (The Villages of Five Points), Lewes, DE - Employees were observed working on the roof at a residential construction site without fall protection while installing roof sheathing.  This exposed employees to fall hazards of up to 20 feet.  The violation was observed on or about October 18, 2013.       Freedom Construction, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 901887, citation number 1, item number 1a, and was affirmed as a final order on 06/18/2013, with respect to a workplace located at Millville by the Sea, Lot 51-54 Substation Road, Millville, DE.

29 CFR 1926.602(c)(1)(viii)(A): A safety platform was not firmly secured to the lifting carriage and/or forks when used by personnel:     a) Lot #136 Hudsons Turn (The Villages of Five Points), Lewes, DE - An employee was observed standing on a platform, approximately 12 feet above the ground, without a safety platform/cage secured to a Gradall all-terrain industrial truck.  The employee was moving materials on the lift used to install roof sheathing.  This exposed the employee to a fall hazard.  The violation was observed on or about October 18, 2013.       Freedom Construction, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.602(c)(1)(viii)(A), which was contained in OSHA inspection number 901887, citation number 1, item number 2 and was affirmed as a final order on 06/08/2013, with respect to a workplace located at Millville by the Sea, Lot 51-54 Substation Road, Millville, DE.
