29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems:    Employees for Grace Construction performing framing of interior walls and bracing walls at 6633 W. Kellogg Dr., Wichita, Kansas were exposed to fall hazards up to approximately 40 feet to the ground below in that door and window openings did not have guardrails and/or employees were not using fall protection for the following locations:      a)  2nd floor door and window openings exposing employees to fall hazards of 10 feet 4 inches.     b)  3rd floor door and window openings exposing employees to fall hazards of 20 feet 8 inches.

29 CFR 1926.501(b)(4)(i): Each employee on walking/working surfaces was not protected from falling through holes (including skylights), more than six feet (1.8 m) above lower levels, by personal fall arrest systems, covers, or guardrail systems erected around such holes:   Employees for Grace Construction performing framing of interior walls and bracing walls at 6633 W. Kellogg Dr., Wichita, Kansas were exposed to fall hazards up to approximately 10 feet 4 inches to the floor below in that the north stairwell floor opening between the 1st and 2nd floor was not protected with guardrails or covers.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):     Employees for Grace Construction erecting walls, setting floor trusses, decking floors and setting roof trusses at 6633 W. Kellogg Dr., Wichita, Kansas were exposed to fall hazards up to approximately 49 feet to the ground below.  Fall protection was not used or not used correctly for each of these tasks.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:   Employees of Grace Construction performing framing work at 6633 W. Kellogg Dr., Wichita, Kansas were exposed to fall hazards up to approximately 49 feet to the ground below.  Employees were not trained to recognize and correct fall hazards, in addition employees were not trained how to use the fall protection that was on site.
