OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees from struck-by and crushing hazards:      On or about October 19th, 2013, employees working near/around the Caterpillar 345B Series II Material Handler were exposed to crushing and struck-by hazards when coming into contact with scrap metal loads and grappler mechanism.     Feasible and acceptable abatement methods to correct these hazards include, but are not limited to the following:          1. Provide and maintain an Owner/Operator manual as stated in American Society of Mechanical Engineers (ASME) B30.25 (2007) Scrap and Material Handlers, section 25-1.9:  Instruction Manuals; paragraph a) "the handler manufacturer or the assemble/modifier shall provide an instruction manual with every handler" and;     2. Develop operating procedures to address ground employee proximity to the material hander as stated in the Caterpillar Performance Handbook, Edition 36, Operator and Machine Protection (April 2006) page 5.  "A well trained operator, working under suitable conditions, utilizing a modern, properly equipped machine provides a machine-operator team capable of giving maximum production.  These factors, along with appropriate job site rules and communication procedures, are essential to coordinate people and machines working together." and;     3. Implement and follow appropriate communication procedures including hand signals to address ground employee proximity to the material hander as stated in the Caterpillar Operation and Maintenance Manual for the 345B series II Material Handler (November 2003), page 17, General Hazard Information.  "Know the appropriate work site hand signals and the personnel that are authorized to give the hand signals.  Accept hand signals from one person only."
