29 CFR 1926.95(a): Personal protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, was not provided, used, or maintained in a sanitary and reliable condition it was necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation, or physical contact. a) On or about October 22, 2013, an employee putting up concrete wall was not provided gloves and did not use safety glasses, exposing employee to eye and other injuries. ABATEMENT CERTIFICATION IS REQUIRED.

29 CFR 1910.1200(g)(8): The employer did not maintain copies of the required material safety data sheets for each hazardous chemical in the workplace: (Construction Reference: 1926.59) a) On or about October 22, 2013, the employer did not maintain material safety data sheet for employees who use chemicals such as stucco mason mix, cement grouts and not limited to masonry cement type S, which exposed workers to minor skin irritations.
