29 CFR 1926.453(b)(2)(v): A body belt was not worn and a lanyard attached to the boom or basket when working from an aerial lift: a) Front side of building: On October 23, 2013 and at times prior thereto an employee performed siding activities from an aerial lift without a fall protection system in place. Note) As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system. The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated under 1926.502(e). Note) Abatement certification IS required for this item.

29 CFR 1926.454(a): The employer did not have each employee who performs work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards: a) Jobsite: On October 23, 2013 and at times prior thereto an employee did not recognize or acknowledge the hazard of not properly wearing a fall protection system while in an aerial lift. Appropriate actions were not taken to minimize the hazard. The employee had the leg straps of his harness adjusted so they hung around his knees. b) Jobsite: On October 23, 2013 and at times prior thereto an employee did not recognize or acknowledge the hazard of not wearing a fall protection system while in an aerial lift. Appropriate actions were not taken to minimize the hazard. The employee attached a lanyard to the straps of his tool belt in an attempt to use it as a harness, and used a plastic bag as a keeper for the front. Note) Abatement certification IS required for this item.
