OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck by hazards of:     a. 32 Bishop Street, Jersey City, NJ - Shipping & Receiving Warehouse       Employees and temporary employees were exposed to struck by hazards of collapsing racks of the metal storage racking system where the employees warehoused merchandise.  Metal racking systems were not free from damage to stanchions and braces, and were not properly anchored to the floor.         Violation observed on or about January 29, 2014

29 CFR 1910.304(f)(1)(iv): Overcurrent devices for circuits rated 600 volts, nominal, or less, were not readily accessible to each employee or authorized building management personnel:  a. 32 Bishop Street, Jersey City, NJ - Circuit Breaker Panel near parts counter  Sufficient clearance was not maintained for access to the circuit breaker panels used daily to control the building lighting system, which permitted ready and safe access for operation.  Large storage containers were placed below the circuit breaker panels and items were stacked upon them not allowing for ready access.  Violation observed on or about January 29, 2014  32 Bishop Street, Jersey City, NJ - Circuit Breaker Panel near parts counter  Sufficient clearance was not maintained for access to the circuit breaker panels used to control the forklift battery charging system, which permitted ready and safe access for operation.  Large storage containers, auto parts, and lumber  were placed in front of the circuit breaker panels which did not allow for safe operation of the circuit breakers.
