29 CFR 1910.178(a)(4): Modifications and additions which affect capacity and safe operation of powered industrial truck were performed by the employer without the manufacturer's prior written approval:    a)  On or about 10-21-13, two employees who were transferring used roofing materials to ground level were working twenty-five (25) feet above concrete surface from an unauthorized personnel basket which was elevated by the forks of a Terex Handler TH644C.      ABATEMENT CERTIFICATION AND ABATEMENT DOCUMENTATION REQUIRED.

29 CFR 1910.178(l)(1)(ii): The employer did not ensure that each operator had successfully completed the training required by paragraph (l) prior to permitting an employee to operate a powered industrial truck; and as referenced by the note contained in 1926.602(d):  a)  On or about 10-21-13, the employer did not provide powered industrial truck operator training for two employees who did not associate hazards with the operation of a Terex Handler TH644C forklift without following manufacturer recommendations in knowing what the machine can safely lift, understanding the decals, and following safety instructions.  ABATEMENT CERTIFICATION REQUIRED.

29 CFR 1926.451(e)(8): Direct access to or from another surface was used when the scaffold was more than 14 inches (36 cm) horizontally and/or 24 inches (61 cm) vertically from the other surface:    a)  On or about 10-21-13, employees were using a Skyjack scissor lift to access/egress a roof surface twenty-five feet above concrete surface.  The lift platform was positioned greater than thirty (30) inches below the roof edge, and employees were climbing up and/or down the platform guardrail; one employee jumped off the roof edge onto the platform to exit the roof surface.     ABATEMENT CERTIFICATION REQUIRED.

29 CFR 1926.501(b)(15): Each employee on a walking/working surface 6 feet (1.8 meters) or more above lower levels was not protected from falling by a guardrail system, safety net system, or personal fall arrest system:    a)      On and about 10-21-13, employees who were tearing off roofing materials were walking/working on a 1.5:12 pitch metal roof with the peak greater than thirty (30) feet above concrete surface and the sidewall roof edge twenty-five (25) feet above concrete surface without utilizing fall protection equipment; several sections of the roof had been removed creating six open edges.      ABATEMENT CERTIFICATION AND ABATEMENT DOCUMENTATION REQUIRED.
