29 CFR 1910.22(a)(1): All places of employment, passageways, storerooms or service rooms were not kept clean and orderly or in a sanitary condition:         Frac Sand unload Area:  on or about October 23, 2013, employees were exposed to the hazard of blowing Frac sand containing silica from spilled sand throughout the area that the employer has not ensured is cleaned up in a timely manner while employees unload railcars.

29 CFR 1910.1200(h)(1):  Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area:         RLI Rail Yard, On or about October 23, 2013 and at time prior thereto, employees were unloading silica sand from rail cars via a conveyor system to commercial 18 wheeler sand trucks or open bed trucks without being trained on the hazards of silica.

29 CFR 1910.134(c)(1): A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use:         RLI Rail Yards, On or about October 25, 2013, employees were required to wear 3M half face tight fitting respirators within 10 to 15 feet of Frac sand being unloaded from rail cars to commercial sand trucks and the employer did not establish a written respiratory protection program or implemented any of the provisions of a program.
