OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to asphyxiation due to oxygen deficiency and chemical toxicity from sewer gases while entering a confined space:      (a)  On or about 10/19/13 - Jones Road/Well Road Sewer Project near Mill Creek subdivision, Athens, AL, employee(s) entered a manhole to place a pneumatic plug into an active sewer pipe.  Entry was made without forced air ventilation and air monitoring equipment was not utilized to test the space for potential contaminants.

29 CFR 1926.21(b)(6)(i): Employees required to enter into confined or enclosed spaces were not instructed as to the nature of the hazards involved, the necessary precautions to be taken, and in the use of protective and emergency equipment required:     (a)  On or about 10/19/13 - Jones Road/Well Road Sewer Project near Mill Creek Subdivision, Athens, AL,  employee(s) were not instructed as to the hazards associated with confined spaces prior to entry into a manhole which contained an active sewer. Instruction did not include a discussion of procedures and practices such as rescue equipment and emergency procedures for safe confined space entry operations and a discussion of monitoring and testing equipment to be utilized to assure safe entry.

29 CFR 1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees:    (a)  On or about 10/19/13 - Jones Road/Well Road Sewer Project near Mill Creek Subdivision, Athens, AL, employees working in an excavation, at approximately 14 feet, were not provided a ladder for egress.    Christopher Professional Enterprises, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.652(c)(2), which was contained in OSHA inspection number 679818, citation number 1 item number 1 and was affirmed as a final order on October 25, 2012, with respect to a workplace located at 801 Main Street NW, Hanceville, AL.

Christopher Professional Enterprises, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.652(a)(1), which was contained in OSHA inspection number 679818, citation number 1 item number 2 and was affirmed as a final order on November 7, 2012, with respect to a workplace located at 801 Main Street NW, Hanceville, AL.
