The planks were used to bridge the basement alcove opening to the framed doorway of the residence, exposing employees to falls of approximately 9 1/2 feet deep.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501 (b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502: At jobsite located at 15900 King St, Overland Park, KS, employees engaged in residential framing worked on an elevated surface without fall protection, exposing them to falls in the following instances: 1) Worked on an elevated surface joining roof supports, while standing on two 2x6s without fall protection, exposing the employee to a fall of approximately 12 feet to the second floor surface below. 2) Worked on the floor adjacent to the edge of the second floor cutting wood without fall protection, exposing the employee to a fall of approximately 10 feet to the wood floor below. JIM MURPHY was previously cited for a violation of this occupational safety and health standard or its equivalent standard (29CFR1926.501(B)(13)), which was contained in OSHA inspection number 724781, citation number_001, item number 003 and was affirmed as a final order on January 28, 2013, with respect to a workplace located at 15309 Bond St, Overland Park, KS 66221.
