29 CFR 1926.451(a)(6): Scaffolds shall be designed by a qualified person and shall be constructed and loaded in accordance with that design. Non-mandatory Appendix A to this subpart contains examples of criteria that will enable an employer to comply with paragraph (a) of this section.    a.  On or about October 23, 2013 - at the above addressed jobsite, an employee was performing finish trim installation from a tubular welded frame scaffold in conjunction with a ladder jack scaffold, approximately sixteen (16) feet above the ground, that was not designed by a qualified person, thereby exposing the employee to a fall hazard.

29 CFR 1926.454(a): The employer shall have each employee who performs work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards. The training shall include the following areas, as applicable:  a.  On or about October 23, 2013 - at the above addressed jobsite, an employee using a tubular welded frame scaffold in conjunction with a ladder jack scaffold was not trained to recognize the hazards associated with the use of such scaffolds, thereby exposing the employee to the hazards associated with falls.

Guardrail systems shall be installed before the scaffold is released for use by employees other than erection/dismantling crews.  a. 29 CFR 1926.452(c)(3): Frames and panels shall be joined together vertically by coupling or stacking pins or equivalent means.    On or about October 23, 2013 - at the above addressed jobsite, an employee was performing finish trim installation from a tubular welded frame scaffold approximately sixteen (16) feet above the ground, which had frames that were not joined together vertically by the use of stacking pins.  The employee was thereby exposed to the hazards associated with scaffolding collapse.

29 CFR 1926.451(b)(5)(ii): Each platform greater than 10 feet in length shall not extend over its support more than 18 inches (46 cm), unless it is designed and installed so that the cantilevered portion of the platform is able to support employees without tipping, or has guardrails which block employee access to the cantilevered end.    a.  On or about October 23, 2013 - at the above addressed jobsite, an employee was performing finish trim installation from a tubular welded frame scaffold in conjunction with a ladder jack scaffold that had a platform extending greater than eighteen (>18") inches past its supports, thereby exposing the employee to a fall of approximately sixteen (16) feet.

On or about October 23, 2013 - at the above addressed jobsite, an employee used a six (6) foot step ladder as means of support to a ladder jack scaffold plank.  This type of a ladder is not designed for such purpose, thereby exposing the employee to the hazards associated with falls.
