OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm:       This violation occurred on or about October 23, 2013, and at times prior thereto, when W.B. Johnston Grain Terminal Elevator did not provide a complete fall protection system while employees were engaged in loading grain from the top of rail cars approximately 15 ft. above ground.  This exposed the employees to the recognized hazards of falls.

29 CFR 1910.146(g)(2)(i): The employer did not provide training so that all employees whose work is regulated by this section acquire the understanding, knowledge, and skills necessary for the safe performance of the duties assigned under this section before the employee is first assigned duties under this section:      This violation occurred on or about October 23, 2013, and at times prior thereto, for temporary employees engaged in entering permit-required confined spaces such as, but not limited to pits, the employer did not train employees on the hazards of permit-required confined spaces prior to the employees entering these spaces.

29 CFR 1910.272(e)(1)(ii): Current employees, and new employees prior to starting work in the grain handling facility were not trained in the specific procedures and safety practices applicable to their job tasks including but not limited to cleaning procedures for grinding equipment, clearing procedures for choked legs, housekeeping procedures, hot work procedures, preventive maintenance procedures and lockout/tagout procedures.       This violation occurred on or about October 23, 2013, and at times prior thereto, for temporary employees engaged in performing lockout/tagout procedures, the employer did not train employees on the safety practices for lockout/tagout exposing employees to the hazards of being caught in or struck by machinery.
