Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being struck-by, caught-in, and or crushed-by forklifts: On or about October 24, 2013, and at times prior there to, at 400 S. Hudiburg Circle, Suite A, Oklahoma City, OK 73108, the employer did not ensure that forklift trucks were provided with a functioning seatbelt for employees to wear while operating the forklift truck.

29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l): On or about October 24, 2013, and at times prior there to, the employer did not ensure that an employee operating a forklift was properly trained and competent by requiring the training and evaluation required by paragraph (l), exposing the employee to a struck by, caught-in, and or crushed-by hazards.
