OSH ACT of 1970 Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm in that employees were exposed to the hazard of crushing injuries from slipping and/or falling Boom forklift attachment. (a) 4285 Alatex Rd, Montgomery AL 36108: Caterpillar model GP40K1 Forklift used to transport granite slabs and countertops in the facility was operated with the boom attachment unsecured to the forks of the forklift. (b) 4285 Alatex Rd, Montgomery AL 36108: Nissan Forklift used to transport countertops in the facility was operated with the boom attachment unsecured to the forks of the forklift.

29 CFR 1910.178(m)(5)(i): When a powered industrial truck is left unattended, load engaging means were not fully lowered: (a) Facility: On or about October 24, 2013: the employer allowed employee to leave a Caterpillar GP40K1 Forklift unattended with the load engaging means raised approximately 6 feet exposing employees to struck-by and crushed-by hazards. (b) Facility: On or about October 24, 2013: the employer allowed employee to leave a Nissan Forklift unattended with the load engaging means raised approximately 1 foot exposing employees to crushed-by hazards.
