OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to potential crushing hazards from falling loads and/or lift parts:   (a) Garage Area, Seven Mechanical/Hydraulic Automotive Lifts: On or before October 14, 2013, employees were exposed to struck-by and caught between hazards while working, in that annual inspections and maintenance of automotive hydraulic lifts had not been conducted.

29 CFR 1910.22(d)(1): On every building or other structure, or part thereof, used for mercantile, business, industrial or storage purposes, the loads approved by the building official were not marked on plates of approved design and securely affixed in a conspicuous place in each space to which they relate:   (a) Attic Area: On or before October 25, 2013, employees were exposed to falling through the floor in that the employer did not mark the weight capacity of the tire storage area. A stairwell was abandoned in the attic and covered with substandard flooring.

(b) Attic Stairs: On or before October 25, 2013, employees were exposed to fall hazards in that a hand rail was not available on the left side of the stairs ascending.     (c) Attic Stairs: On or before October 25, 2013, employees were exposed to fall hazards in that a rail was positioned to low to be considered a handrail on the right side of the stairs ascending.

The employees were exposed to laceration/puncture hazards in that nails are protruding down from the ceiling in the attic area.
