Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer does not furnish to each of his employees employment and a place of employment which are free from the recognized hazard of being caught-in/between which are causing or likely to cause death or serious physical harm to employees: This violation occurred on or about October 23, 2013, on the east side of the Union Tank Car facility where an employee was exposed to caught-in/between hazards when approaching the Case 580M (SN: N60400870) backhoe loader arm to throw metal into the cab without turning the backhoe off. Pursuant to 29 C.F. R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation describing the steps that it is taking to ensure that the area around the swinging boom is kept clear, objects are not thrown in the cab of backhoe and the engine is shut off before leaving the cab of the backhoe.
