29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury:      On or about October 24, 2013 at worksite 1017 SW Drake Circle in Lees Summit, Missouri- Employees were laying and connecting a sanitary sewer pipe in a trench that was 8 to 14 feet in depth and were not instructed in the recognition and avoidance of the unsafe conditions while working in a trench. An employee was fatally injured in a trench that collapsed.

29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins:      On or about October 24th, 2013 at worksite 1017 SW Drake Circle in Lees Summit, Missouri- Employees were exposed to unsafe working conditions in a trench that did not have daily or periodic inspections performed to ensure the safety of those employees in the trench. 29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(c):      On or about October 24, 2013 at worksite 1017 SW Drake Circle in Lees Summit, Missouri- Employees were laying a sanitary sewer line in a trench that was between 8 and 14 feet in depth, between 3 and 8 feet in width, the length of the trench was in the shape of an "L" and was greater than 40 feet in length and the trench was not protected from a cave-ins by any adequate protective systems.           ABATEMENT VERIFICATION FOR THIS ITEM IS NOT REQUIRED.
