OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish to each of his employees employment and a place of employment which are free from recognized hazards that are causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards: (a) Construction Site: On or about October 23rd, 2013, and at times prior, employees were exposed to a fall hazard of approximately thirteen feet to the concrete below when the employee climbed in and out of the basket to retrieve work tools and gain access to the roof of a building using a snorkel 260 MRT scissor lift.

29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems: (a) Construction Site: On or about October 23rd, 2013, and at times prior, employees were exposed to fall hazards of approximately thirteen feet to the concrete below while performing heating and cooling installation on a 4-12 slope roof.
