29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, crossbraces were used as a means of access. On or about October 24, 2013, employees were accessing the one-tier, tubular welded scaffold that was erected approximately 6 feet high by climbing the outside rails and not utilizing a ladder, exposing the employees to a fall hazard.

29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets: On or about 24 October 2013, three employees were performing masonry work on a home under construction, from a one-tier, tubular welded scaffold, without the use of hard hats. Tools, materials and stone blocks were located on the platform of the scaffold where employees were walking below, exposing the employees to the hazard of being struck by falling objects.
