29 CFR 1926.451(c)(2)(v): The employer used forklifts  to support scaffold platforms without ensuring that the entire platform was attached to the fork and that the forklift was not moved horizontally while the platform was occupied:     On or about October 29, 2013, one employee was riding the platform, while the all-terrain forklift was traveling on the street. This condition exposed the employee to a fall greater than 6-feet.

29 CFR 1910.178(l): Operators were not trained in the safe operation of powered industrial trucks:     29 CFR 1926.602(d): The employer did not certify that each operator had been trained and evaluated as required by paragraph 29 CFR 1910.178(l):Note: The requirements applicable to construction work under paragraph (d) of this section are identical to those set forth at paragraph (l) of 29 CFR 1910.178.     On or about October 29, 2013, an employee was riding in the platform with the load while the forklift traveled on a public access way. The employer did not provide forklift training to enable the employees to recognize the hazard. Hazards associated with forklift operations such as but not limited as fall protection and struck-by hazards.
