29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): a) On October 18, 2013 and at times prior thereto; second and third floor; employees were observed working near the edge of the platform without a personal fall arrest system in place to prevent them from falling 20-30 feet to ground level. b) On October 18, 2013 and at times prior thereto; second and third floor; employees working near unguarded floor openings, future stair area, without a personal fall arrest system in place to protect them from falling 20-30 feet to ground level.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed On October 18, 2013 and at times prior thereto; throughout the site; the ladder used to access the upper floor platforms were extended twelve inches below the working platforms. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.
