29 CFR 1926.95(a):  Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, was not provided, used, and maintained in a sanitary and reliable condition wherever it is necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation or physical contact:  A.  Mathew Lengacher Construction worksite located at 5752 Hamptons Dr., Monclova, Ohio: On or about October 28, 2013, the employer did not ensure employees were wearing proper eye protection while operating  pneumatic nail guns to secure sheets of plywood to a residential structure. The employees were exposed to potential flying object hazards while operating the pneumatic fasteners.  Matthew Lengacher Construction was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.95(a) which was contained in OSHA inspection number 311608772, citation number 1, item number 1 and was affirmed as a final order on May 22, 2009, with respect to a workplace located at Monclova, Ohio.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure:  A. Matthew Lengacher Construction worksite located at 5752 Hamptons Dr., Monclova, Ohio: On or about October 28, 2013, the employer did not ensure employees were protected from falls while installing roof sheathing on the west side of the two story residential structure. Employees were exposed to a fall distances up to approximately 20.00 feet from the 8/12 pitched roof.   Matthew Lengacher Construction was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13) which was contained in OSHA inspection number 311608772, citation number 1, item number 2 and was affirmed as a final order on May 22, 2009, with respect to a workplace located at Monclova, Ohio.
