OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish the employees employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm in that employees performing milling work were exposed to struck-by/crushing hazards:    a)Milepost 50.1 of the South-Bound Garden State Parkway (Closed Shoulder):  On or about 10/30/13 employees were exposed to internal motor vehicle and heavy equipment traffic. An employee performing milling operations was exposed to being struck-by/crushed by a Mack dump truck operating in reverse gear.  The employer did not have an internal traffic control plan in place.    NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
