29 CFR 1910.138(b): The employer did not base selection of appropriate hand protection on an evaluation of the performance characteristics of the hand protection relative to the tasks to be performed, conditions present, duration of use, and the hazards and potential hazards identified: Acetone. On or about 10/30/13, at the warehouse the employees were using vinyl gloves to handle acetone. The employer did not provide the correct gloves (neoprene, latex/rubber, or butyl) to the employees while they were handling Acetone to remove paint on cans.

29 CFR 1910.1200(e)(1): Employers shall develop, implement, and maintain at each workplace, a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, material safety data sheets, and employee information and training will be met about Acetone. On or about 10-30-13, the employer did not have a written hazard communication program while employees used chemicals such as Acetone at the workplace.
