The rails of the portable ladders used to access the roof were not extended at least 3 feet above the upper landing surface exposing employees to a potential fall hazard. Observed on or about 10/30/2013.

29 CFR 1926.20(b)(2): The employer did not develop an accident prevention program, that provided for frequent and regular inspections of the job sites, materials, and equipment, to be made by competent persons designated by the employer. a) 5 Fisher Island Court, Regency by Toll Bros.: The employer did not initiate a program for a competent person to conduct frequent and regular inspections of the jobsite, to identify hazards and/or stop the work in the event workers were placed in a hazardous condition. As such, D&A Improvement Inc. employees were conducting roofing activities on the roof of a multi-story new residence under construction without any form of fall protection. The side rails of the portable ladders used to access the roof were not properly extended 3 feet above the landing surface. Employees were exposed to fall hazard of 14 feet to greater than 21 feet from the roof's eave and rake edge to the ground. Observed on or about 10/30/2013. The employer, D&A Improvement was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.20(b)(2), which was contained in OSHA inspection number 891463, citation number 01, item number 001, and was affirmed as a final order on 06/18/2013, with respect to a workplace located at 100 24th Ave., Seaside Park, NJ. The employer, D&A Improvement was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.20(b)(2), which was contained in OSHA inspection number 909242, citation number 01, item number 001, group b, and was affirmed as a final order on 08/23/2013, with respect to a workplace located at 456 Ellison Drive, Normandy Beach, NJ.
